How old it the child? Both parents should consider the train for the revision of the order.

It's not much more expensive if you consider gas and tolls.

Of course, Mom should be paying most if not all of this expense.

Hubby's son is 7. The compromise came from dad because the judge said because of the contempt that he was going to make her drive the whole way on Florida visits, dad said no, he would meet her halfway. This year was the farthest pick up for him, last year it was the closer one.

It is stipulated who drives where and all the times of pick up and drop off. The last 2 years it stipulated exact dates, so there was nothing like this that could happen. His last order was the longest order I ever saw for a temporary visitation order, but that was the only way to get her to comply. Hence why he is having trouble now. It is a finely tuned order down to phone calls and webcam and the times for such.

I feel that another email at this juncture will just add more fuel to the fire and he should leave it as is. Or maybe he should try one last time.

If he did file for contempt....could he add a listing of all the dates to be incorporated or would that be another order and all crap that entails? The school has their calendars up to 2010 now.

MLK is a national holiday right? I'm off, the banks are closed, federal/state offices are closed right?

No judge is going to believe she didn’t know she was supposed to drive.

Such an email should come form his lawyer at this point.

I’d pick up kiddo anywhere at this point. Returning him to the pick up point would NOT be contempt. But it aint nice either. Sigh.

I wouldn't consider MLK a major holiday. Just b/c it's a national holiday, doesn't make it a major holiday.

There are lots of national holidays that aren't major.

Where I live, we have Mardi Gras. Not a national holiday, but in our neck of the woods, considered a major holiday. Our schools are out for 2 days for it.

Go figure.

Mardi Gras....oh yeah! Something fun and exciting. I worked out of town once during Mardi Gras in Louisiana and wow....never again schedule work during that time.

Once I posted that, I thought the same thing. Either way...it seems everyone is in agreement that it is his time in Florida. So phone call 1st thing to attorney to do what they need to do.

As I said before....thanks again to everyone, I will keep you posted.

I agree. It's typically NOT a holiday most working people get off unless they work for government.

But, MLK is already covered by the first section she posted of the parenting plan:

1. Every other weekend with the Father commencing 8/31/07. The father shall be entitled to exercise one weekend visitation per month in the State of Florida. Other weekend visitations shall be exercised by the Father in the county of the Child's prmiary residence. The father shall be entitled to exercise weekend visitation in Florida on all long weekends in the childs school schedule.
So it doesn't even have to be a holiday - state or national - just a long school weekend (ie. could be long weekend due to staff development day).

Update

Attorney faxed letter over to her attorney that showed still on record. The attorney said it is his weekend in Florida...so he will wait.

Should be an interesting phone conversation between them. I found another email back from September that mentions the same schedule due to Thanksgiving and she agreed that both of those weekends were in Florida too.

Mom is picking and choosing whatever schedule she wants. So that is where he is for now. He's still going tomorrow and is going to call the police to file a report before he leaves to document.
