I'm not sure where the conflict is. Your workers comp from the carrier should be roughly 2/3rds of gross pay. Your supplemental pay, which is NOT subject to the law willly quoted, is at net pay as per the policy. Where's the problem?

My pay is much more than maximum worker comp. Also the purpose of supplement on the contract is to minimize of the hardship caused by injury. The supplement is taxable and other deductions should be applied too. If the net(supplement) is based on the amount after all taxes and withholding, the supplement is again subject to taxes and others except the workers comp. It is double taxation, isn't it? So it kills the purpose of the contract. If calculated in numbers, 100(the gross)x70%=70 but 60(the net: 100x60%-my all deductables) x70%=42. It makes a lot of difference.
Unfortunately I have to be off several months due to injury so it means a lot. That is a reason I look for anything to help my case. It does seem bright if Cbg said like that. Anyhow thanks for help.

Contact your union tomorrow to be sure, but really, there is no double taxation. They are simply claiming that the benefit is based on after-tax earnings.

I should. Years ago Payroll twisted overtime pay of employees and refused to correct it. Union eventually sued and won. I heard they paid over million. Different classification has different overtime rule and pay.
I hope Union is interest in my case and investigate all cases like mine. Thanks.
