My husband was arrested and charged with Convicted felon in possession of a firearm. I am wondering how the federal sentencing works. I read somewhere that the federal judge has to use a formula using the current charge and past record. (He has had theft and drug charges before. This is his fourth time in prison.) Not too long ago, in the newspaper (a ND paper), I read that the federal guidelines are considered unconstitutional, and that the judge doesn't have to follow them. The guidelines - is this that formula I read about? Can someone explain this to me a little better? About how much time do you think he will get? He says he's expecting to get 10 years! Is he right?
