Please someone offer some type of help.
I have 2 boys and I live in Florida. The father is in New York State and is incarcerated.
I left NY because of receiving numerous threats on my life from the father and his family.
Now he has petitioned the court stating the kids are indanger and a warrant should be issued for my arrest and the kids should be given to his mother!
He has also filed for a fradulent warrant for my arrest stating I stole his identity I had a cell phone in his name!
I am scared and do not have money to pay to an attorney and his mother is a drug dealer and has tons to waste on ruining my life.
Can anyone help me . Can New York rule over me in Florida?

1. Is he the legal father?
2. Are there any court orders regarding custody?
3. Explain this warrant issue. How can her just say you should get a warrant, and for what.
4. What is he incarcerated for?
5. Why did you put his name on your cell account?

It sounds to me as if he has a valid complaint (although, not really a big deal, imo).

I was looking for serious help on here,

yes he is the legal father,
There are no current upto date custody orders on children
he is incarcerated for selling a controlled substance.
I am not kidding if you would like to look at inmate lookup I will give you his information
I got a phone in his name because of my credit I could not afford to put one in my name.
He demanded that I put it in his name because he said he needed to always know where the kids were.
I am a victim of domestic violence and left him after years of abuse and he still tried to controll my life from behind bars.
I got the phone figuring, I needed a phone anyway so why not get it. I didnt have to answer his calls

by upto date I just meant, there had been nothing that was updated since his incarceration. The order was before my other child was even born.
When you go online all you do is enter your information. I did not have to sign anything for the phone. I didnt know there was a law against having a cell phone in a partners name, how could a detective issue a warrant for that!

I'm with Shay on this one. ARE there ANY custody orders? They don't go "out of date" until a child becomes an adult.

no I did not lie. It was an online form I filled out, he provided the information and I filled it in

She could have ordered it online. However, it sounds like he gave her permission to do so...in fact insisted that she do so.

Well if they dont go out of date then I they state nothing about me leaving the state.
I just didnt know if Ny can issue a warrant for me to surrender my kids . He has petitioned for that stating they are unsafe and is asking for an emergency order.

How long have you and the children been in FL?

What do you mean by no "up to date" custody orders?

You need to find a way to get an attorney, you may have to borrow the money somewhere.

New York definitely can make rulings that FL would enforce, particularly if you don't or can't fight jurisdiction. You really NEED an attorney.

I am not really concerned with the warrant . The police department said it is not a major issue. My main concern is Does NY have jurisdiction over me now that I am living in florida?
I find it absolutley crazy that he can disrupt my life this bad from behind bars
