Ex was just ordered to pay child support, in court the attorney said that the amount would be garnished from his paychecks.
The order was faxed to WSSR, and an account was set up. I received a call yesterday from my support officer and he told me there was a "problem" with the account. He said even though our court order states that the cs will be garnished, the attorneys missed having one specific form signed, so all they can do at this time is accept payments, if he makes them and then send them to me. If he doesn't make payments there is NOTHING they can do because that form giving them authorization to enforce the order is missing.
My order says he has to pay x amount of dollars per month, due by the 15th. I understand that if the wages were garnished this would not be the case, because they would take a certain amount out per paycheck. But the wages will not be garnished, and my ex decided he was going to pay a specific amount per week, he divided the total amount by 52 weeks in a year. (Sorry, I am confusing myself)
Anyways, the point is if he does that one month he will pay LESS than the court ordered amount, and another month he will pay MORE (If there are more than 4 weeks in that month) At the end of the year, if he makes all of his payments it will come out to the right amount, but the amounts would be different every month. I would prefer that he just pay the set amount per the court order every month, and then if there are extra weeks (He is paid weekly) then he gets a full paycheck and it is less confusing. I hope this makes sense.
Is this the way it is normally done, or is my ex making up his own rules?
