Another Child support question

Ex was just ordered to pay child support, in court the attorney said that the amount would be garnished from his paychecks.

The order was faxed to WSSR, and an account was set up. I received a call yesterday from my support officer and he told me there was a "problem" with the account. He said even though our court order states that the cs will be garnished, the attorneys missed having one specific form signed, so all they can do at this time is accept payments, if he makes them and then send them to me. If he doesn't make payments there is NOTHING they can do because that form giving them authorization to enforce the order is missing.

My order says he has to pay x amount of dollars per month, due by the 15th. I understand that if the wages were garnished this would not be the case, because they would take a certain amount out per paycheck. But the wages will not be garnished, and my ex decided he was going to pay a specific amount per week, he divided the total amount by 52 weeks in a year. (Sorry, I am confusing myself)

Anyways, the point is if he does that one month he will pay LESS than the court ordered amount, and another month he will pay MORE (If there are more than 4 weeks in that month) At the end of the year, if he makes all of his payments it will come out to the right amount, but the amounts would be different every month. I would prefer that he just pay the set amount per the court order every month, and then if there are extra weeks (He is paid weekly) then he gets a full paycheck and it is less confusing. I hope this makes sense.

Is this the way it is normally done, or is my ex making up his own rules?

My wage assignment order told the employer exactly what to deduct depending on the way the NCP is paid.

Weekly? pay X amount
Bi-Weekly? pay X amount
Semi-monthly? pay X amount
Monthly? pay X amount.

The calculation is based on monthly order support amount multiplied by 12 months.

example $500 per month times 12 equals $6000 a year
weekly $115.38
bi-weekly $250
Semi monthly

That is how he should pay it--if you dont insist on the entire amount on the 1st of each month.

No, your ex is actually doing it the correct way. When a NCP is paid weekly, the CSE agency and the employer takes the monthly ordered amount, times that by twelve, then divides by 52 to arrive at the correct per week amount. Yes, some months it will be a few dollars less, but then other months it'll be more. At the end of the year it all evens out and the correct amount will have been paid.

I think I understand your concern, it would be nice for you to know exactly what day the money will arrive, but that really isn't realistic. The best thing to do is to budget so that you don't have to rely on the CS arriving on the same day(s) each month.

That would make perfect sense to me if it was to be garnished out of his wages, but its not so I didn't think he could do it that way, I don't mind at all if it is not paid in full by the 15th, because I know that could be difficult. My thought was that he could use the first four paychecks, calculate the amount for each one and that way it is the same amount every month and if he gets a fifth paycheck for that month, cs is already paid in full.

To a great extent, you probably should just be glad to get the CS. There's a bazillion UNsupported kids out there. I'd let the details go, as long as I got the CS. But that's just me -- I prefer peace to war. ;)

He has the entire month to pay the support, so long as the total amount is paid, he could pay it by the day if he so desired.
You don't get to make up a budget for him. Dang I would be glad to get the money weekly, or for that matter, monthly, heck once a year would have been an improvement at times. :rolleyes:

I am so very grateful that I will be getting cs for my little ones, and I am not going to try to get him to it any other way, I will just be thankfull if he pays it. I was just curious how it normally works since I haven't gone thru it before. Either way, in the end if he makes all of his payments it will be the correct amount, and that is ok with me.

I think that's a great attitude! It'll take you far -- and besides, it's unfun to be mad about every little thing. :) ;)
