blackshadow, given you don't have a ROFR and didn't give the required notice to exercise time at THIS time, why are you so bent on having THIS time with the child? I looked through your previous thread and other than the child being with his grandfather and step-grandmother (if I read that right) and not with his mom while she's away at another state, I don't see why you are insisting on THESE 4 weeks for your summer time.
My DH has a ROFR in his parenting agreement. Each summer they split the time 50/50. Found out Mom will be out of the country for some of the time she has DD this month. So DH is in a similar situation to yours (and his ex is also very alienating and has been in court for contempt a little less than 2 years ago). And, I can't see the point of him exercising his ROFR because they developed a 50/50 schedule for this summer and if he takes DD the days Mom's out of the country, quite frankly he should GIVE UP other days in exchange. So he will just leave things alone. So why don't you? I get that the grandparents/stepgrandparents don't have as much legal standing as you, but so what?! You only get 4 weeks in the summer for parenting time and this is NOT the time you chose to exercise. The child has a right to visit extended family on Mom's time. Nothing is being taken AWAY from you. Is there a piece of this that's missing? Are you afraid you will NOT get the 4 weeks you'd already arranged with the 60 day's notice required per your CO?
I understand legally you can do this and the most that you're advised would happen is potentially a "slap on the wrist", but I'm not getting why you are so hellbent on REMOVING the child from the relative's house given it is not your time and you do not have a ROFR.
I will also say that I felt CJane was very harsh with you and I did not agree with how she was expressing herself and read back to the previous thread for the history, expecting to still not agree with CJane, but actually I do now having read what I think is the "whole story", as much as you've posted it here.
