Overcast California.

I am so livid right now my entire body is shaking.

Today is my oldest's thirteenth birthday. Court orders state that i have the kids even years, dad has them odd years. Took dad to court for contempt for messing with my birthday last year, and for messing with my xmas. Judge warned ex not to pull this stunt again. But he did it anyway. So back to court on monday. I called the minor's attorney. Left a message, i'm crossing my fingers and hoping the attorney will call him to straighten him out again before 12 today. Grrrrrrr!!!

Ok I am confused.

You took him to court last year for messing with your birthdays and you want to do it this year to. So if you split years how is it you got last year and this year?
He messed with MY birthday last year. I get every year for my birthday, same as dad gets every year for HIS birthday. Today is kids birthday, which i get even years.

As I understand it, he hasn't even violated the court order yet and you're posting an angry, bitter post. Time to lighten up.

Even if he DOESN'T let you have the child for his birthday, it's really not the end of the world. You go back to court and he gets slapped around as the judge promised. You get makeup time. It's not that big of a deal to celebrate a birthday a little bit late. We do it all the time.

You can still be angry about it. ;) Anger is a human emotion and there isn't anything wrong with it.

EDIT: Well... there CAN be... so ignore that last part. It's healthy for a person to feel SOME anger.

Yes, but "I am so livid right now my entire body is shaking." is not healthy.

While I agree about this particular dad, the fact that his actions can still make Isis so angry that she can't see straight means he's still winning, even if the judge does slap him around.

I'm sorry to hear your ex is still not playing fair, Isis. I understand your anger. You follow the court orders and he doesn't. It's an understandable emotion. I would feel that way too. I never want to be in a position where I am using my son to cause my ex to be angry and that is why as CP I try now to always follow the orders and give extra and make up time when needed and/or requested. It sounds like your ex is still trying to use the kids to get to you. That is unfortunate for the kids and for you too.

Okay. So i made my calls, turns out a particular minor's attorney gave someone a call. So dad had someone bring the kids back to his house. I had to cancel the police escort so that's good news.

So, phew! No court!

Now i just feel bad for the minor's attorney.

Which is why I suggested that you shouldn't get all worked up in advance just thinking that there might be a problem. Better to deal with what happens rather than spending your time worrying about your worst fears.

I noticed your location and thought I'd respond to this one. We did a police escort for something similar to Isis' issue in Tennessee.

Cop told us even if the court order was clear and he wanted to he couldn't force father to relinquish child to my wife.

Wife's uncle is the sheriff (EDIT: Or Chief... whichever one isn't elected. He lost the last election. :( ) in a different county and he said the cop was right.

Lawyers in our area told us to call for a police escort though... so we were pretty confused at that point.

For the record, our court order was unclear and the cop still attempted to ask child who she wanted to come with before father pushed police officer out of the way and asked first. Yea... he was reprimanded and daughter felt that she would be punished for saying anything other than that she wanted to stay with father. I'm not making it up... Cop wrote it in report.

Our court order says we alternate birthdays similar to Isis. We have twins and an older girl. Twins birthday he gave us the twins and kept older child. We wrongly (Later informed.) interpreted the order to be all the children. Who would seperate kids on a birthday?

Whatever.. moot point and I've ventured too close into hijacking. Needless to say I feel ya a little bit Isis. He's also been late after asking for extra time and being told we absolutely couldn't... and we couldn't. We had invitations sent out for a party for the girls and with people in our home waiting on children we couldn't have them wait two or three hours.

That was my initiation into this forum. Got a lot of hate for my anger then too. But whatever... People on this forum are pretty rude when they want to be.

Cop also gave all of us a light slap on the wrist for involving them... rightfully so. Said we didn't need him and told the father that he was a jack ***.

EDIT: For those doing math and viewing past history... yes, I have 3 step daughters and one daughter. My ex (thankfully) is a great understanding human being and mother. My wife's ex... Satan. Ex-wife's Ex god's gift to humanity. THANK YOU!

Police report. I'm following the judge. Each time he's done this, the first thing they ask for is a police report. Going down to the police station isn't enough, because the police weren't present and it's only hearsay. In the past, ex won't answer the phone to the officer. So, with my judge i need a police report that was written from a third party witness.

I hate that process myself, it can take hours for the police to show.

O/T And you need to reread your own post to see just what is wrong in your wife's relationship with her ex. WE do not have a court order. WE do not have visitation. WE have nothing when it comes to HIS and HER kids.

Whatever heartless individual. You are right. I don't communicate with the father so it has no bearing on his attitude.

I can type as a married man and be a partner without having to feel bad for it because you want to highlight a post.

Like said in another thread... I don't have a switch to turn off being a person's partner or loving children. I do have the intelligence to stay out of father's life and conversations. So my attitude toward the "We" statements doesn't affect his relationship with her as mutual parents.

Not legally, sweetcheeks. In the legal arena? You're no one. The more you butt in? The more you risk your wife's custody.
