What is the name of your state?TX

Hello all. This question is for me. I recently opened an account with boost moble. Everything was going great; i had great reception, coverage and data speeds. During the first week i recieved a notification that 85 pct of hotspot data has been used. I checked my settings and hotspot was off. A few hours later i got a text that all my hotspot data has been used. I went thru my phone and realized the only data being used was that data being ran through my torrent app(p2p)

I called customer service and asked them ...or more like told them whats going on and could not get any help because none of the reps knew what p2p is or torrents..so they escalated the call to a super visor..i the sup didnt know what i was talking about either so they escalated to a super supervisor and promised me a call back in 24 hours...a week later and many phone calls ive gotten no response as to why p2p is being counted as mobile hotspot.

Now payments due..i dont want to pay until i get an answer because they dont offer refunds.....but today my service was shutboff so i paid the 80 bucks. So i go to the store and talk to rep there. He has no idea what im talking about...so im tired andbjust getting ready to leave when something catches my eye...theres an ad for there 50 a month plan..on the very bottom it says p2p and vpn usage will go against data..he laughs and says thats new to him..so educate him on what it means n told him to disclose this to future customers... Before leaving i ask him to show me in customer agreement where it mentions this amd told him if he could show me id be happy..so he looks and looks and cant find it anywhere in the agreement.

So i have 2 questions 1...how do customer agreements work? Hell i worked for verzon wireless and we were taught a customer agreement is a contract that binds both parties to an agreement. And 2.. It says in the agreement that we have to use a 3rd party mediator to deal with issues..is this effectively giving up my right to take this to court?

You used all your data. It really doesn't matter what app used it.

Is there something here I'm not understanding?

Your p2p or torrent data transfer:

Is it directly to and from your phone or are you using your phone as the “modem” for your computer or something else?

What does YOUR agreement say to the matter regarding p2p?

And yes, the mandatory mediation does prohibit you taking this to court, at least imitiallly

Actually it does make a difference. Op believe p2p transfers wouldn’t me charged on his hotspot data. Most contracts have different allowances for hot spot data than data transferred to or from your phone. When using the hotspot, you are simply using the phone for the data transfer between another device (a computer, tablet, or other phone without internet service) and the internet. The phone is used as a modem to connect the device (the computer etc) to the internet but its through Your phone carrier.

The downloads are being done on my phone to my phone and no where else.
Then you need to ask boost why the p2p transfers are being charged against your hotspot data. Of course it will be charged against your general data plan because it is data rather than voice.

Just to clarify; your concern is it is being charged against your hotspot data and not your general data plan, correct?

My data is unlimited. If i was sharing my internet connection with another device through the phones tether feature then that would be considered hotspot usage. Using torrents how ever work pretty mich like typical downloads. You are downloading a file from a remote location directly to your device. It does not fit into what would be considered hotspot usage in the language they use or anyone else would use.

Thats the fun part. No one, not even the supervisors or tech guys can explain to me why this is happening. Its like no one in boost even knows this is happening except for maybe one boost rep i foind online. The store employees didnt know until i educated them on the little ad they have in store. In small print it says p2p and vpn count against data..but my issue is this i wasnt made aware of this until a month and 160 bucks later and 2..its not listed in the actual customer agreement anywhere..oh and the bonus 99.9 percent of boost workers didn't know this was the case either. Call boost right now and ask them they are gonna try to be smooth and give u a generic answer that sounds good but if you know what your talking about you will discover its rubbish

The system seems to think you were using hotspot.

Since you have seen where they treat P2P and Torrent as hotspot data I'm willing to bet that is in the agreement or in an update to the agreement you received but never read.

Nope. I checked the agreement and had the store rep do the same. I also had the phone guys check..and there is no mention of this. Usually big changes in agreement are ushered in with internal company emails educating the reps on how to deal with questions or concerns regarding said changes. Call boost for the fun of it. Ask them. No one is clued in about any of this

You don't work for Boost so you really have no way of knowing what they sent via internal emails.

You know it is now the policy because you read it yourself at the store.

It’s not as simple as sending an updated agreement. The contract originally signed cannot be altered by either party unless there is a clause in that contract allowing the change.

The contracts I’ve dealt with for phones are not amendable. The stay intact until they expire or they are terminated for whatever reason

But the issue is if he hasn’t been using the hotspot it wouldn’t matter. He has unlimited data so unless he is using his hotspot, he can’t use up his data.

Why are you even concerned that vpn or p2p is charged against your data? If you aren’t using your hotspot and you have unlimited data, it doesn’t matter.
