What instruction? A whistle is not a stop sign. He only whistles before holding up the sign and escorting people across.
Yes, in order to get the attention of cars so they will stop...

Really, you need someone else to talk for you.

Lol that's what I mean. I can't just say [the above mentioned argument about them not being there) and not say I want it dismissed? or do I just say that's it and then they tell me the results?
Only fight this if you have a legally valid defense (you haven't mentioned one yet) AND are willing to retain a lawyer.

Because frankly, you seem to be itching to talk your way into more serious charges.

I don't know what could be a more legal defense than "you accuse me of not stopping for a crossing guard who was not there"

You've already acknowledged that the guard was there.
That's not what I mean....he wasn't actively assisting people to cross the road yet according to VC 2815 which says he has to be in the road helping people cross for you to disobey it.

And that is exactly why you need someone to speak for you.

Don't worry about that part. That's why I'm here.
You seem to misunderstand the purpose of this forum. You are not going to find someone to speak for you on this forum. You need to hire an attorney. Alternatively, you can try to go it alone, but your capability in that respect seems likely to harm you. You may have the option for traffic school.

No but what I am trying to do is test out an arugment.

I understand that.
Let me be Frank with you: When you first posted, I was totally on your side. The more you talked (virtually speaking), the less I was on your side. You NEED someone to represent yourself because you seem to have a knack for turning the tide against yourself.
