Since OP signed the AOP & has established 'status quo' (over 6 mos.- 1 yr. of a consistent schedule), along with the recent change in parenting time...OP actually has a good chance of getting at least 50/50 if he follows the advice he's been given ASAP.
THat is why I advised as I did, apparently the AOP doesn't come with instructions for what comes next in unmarried parents.

ok, the mother wants no business talking about any court papers. I address them as papers in case I were to die, my insurance benefits would go... she will have no part in this.

What should I do?

Email her with facts about california law?

Get a DNA test, and take her to court

Go to court and have an emergency custody request; My son has a gash on his forehead 1 1/4" long due to neglect.

I need some advice, my lawyer is not available right now.

Call your lawyer first thing in the morning and tell him you want to go to court to establish paternity and ask for emergency custody due to the neglect.

How do you know it's due to neglect and not kids being clumsy?

Did you take the child to the ER?

Go to court- establish Paternity LEGALLY- Petition the court for custody/visitation.

If/When you do not agree~ You will get a date set for mediation. The mediator's report will weigh heavily w/the court's decision.

she may be a little bitter about the breakup and her living situation. She may also be getting bad advice; the first time I contacted her, she agreed, then half hour later, she called back to disagree. She's been hitting the bottle as of late and could not take care of the baby on a few occasions because of it.

Regarding the cut on the head; She told me she left him alone a few minutes so she could eat. She left him with another kid and her sisters; none of them knew what happened, since our boy never cried about it. Make no mistake, it's a very big cut

Oh, I'm not saying mom is a peach. But I also know from experience, as I'm sure most parents do, that sometimes kids can be hurt quite badly w/out anyone being neglectful.

Are her sisters adults? Did you take the child to the ER? Is he showing any signs of other head injury?

No I did not take him to the ER. I am gonna email the pictures to my attorney, and hopefully she will give me some advice. maybe police report? I'm not sure, I'm at work a lot, so it's hard to get things done.

It's been 2-3 days since the cut incident, but it's still there.

Dam noggins . Hit my noggin again . Yepper If Sissy's an Adult , so she hit the bottle a few times ? , as long as sissy is old enough to BB sit ?

Anyways If a Parent is that Dam concerned < A big one > why hasn't child protective been called , and an investigation ????? HUH ?? Huh ???

Well, see, here's the problem.

You didn't think the wound was serious enough to seek medical treatment for the child. Which either means the cut wasn't serious, or you're also neglectful. Why would you file a police report if nothing criminal happened? Are you claiming this was an intentional injury and you've waited 2-3 days to report it?

If mom left the child with adults (or even teenagers) whom she has reason to believe are competent to watch the child for a brief period of time, she was not being neglectful. YOU leave the child while you're 'at work a lot'. Would you want Mom to be claiming that you are neglectful if the child is ever injured while in the care of your family members?

If you have an attorney they should be handling this for you, contact them re the recent injury and get your child to a doctor to verify and document the injury, they are mandated reporters. Then read my previous post from 6-5-6 where I stated exactly what you should do, however that was before you stated you had an attorney.

Go to the family law faciliatir's office located in your county Superior court, file for temp emergency custody, based on the fact that you already signed the AOP and have the child 6/7 and mom is homeless. File for custody, child support and visitation. Be sure to collect your evidence, receipts and declarations. Your county may have a website where you can access their self help section or you may retain a family law attorney.
Please update us after you speak with your attorney or go to the FLF office and court.
