you could, but you might be wiser to let your lawyer do it as soon as he is onboard, especially since you'll be telling the judge you have an attorney, you can ask the judge to order temp visitation until this is settled.

Did you report the baby's dad for breaking the restraining order? Is your child included in the restraining order?

so when i go into court to get temporary visitation what is that and how does it work? How do I go about asking for that? What do I say? what are my chances of it being granted
?? there is no reason for me not to be allowed visitation.

there is one against me permitting me from seeing my son. this is so confusing but i will try and make it easy to understand.

on october 11th, 2005 i had my ex arrested for domestic a&b,a&b w/ a dangerous weapon, & threatening to commit a crime ( murder ) - (the threat was added after he threatened me after his miranda rights wee read to him )
On october 12th, 2005 my ex boyfriends mother filed a restraining order against me ( i believe 100% just to get back at me for putting her son in jail and to prevent me from seeing my baby ) the only reason the restraining order against me was granted was b/c i previously lived with her.

is that confusing. im sorry if it is.

yes i filed that he violated. this is also the second offense of domestic a&b against me. he was also on pre-trial probation when he did it the second time. when he violated the restraining order he also violated his release terms from court when he was let out on $500.00 bail.
now the mother filed violation of restraining order against me b/c i called my son's daycare to see if he was doing okay. i had no idea this was a violation and the restraining order was never explained to me.

im so confused and hurt at this point. i dont know what to do anymore. it seems that everytime i get something on my ex she tries (and succeed's) at getting something on me also, even with no proof.

does the restraining order against you say you can't have contact with the child???

yes, it does. but i didnt know that asking his daycare provider if he was okay was VIOLATING that in ANY way. Isn't there something I can do about being missinformed??? I didnt delibretly violate the order as my ex-boyfriend DID. And no, my baby's dad lives with my son (go figure) it makes no sense.

Did you respond to her restraining order hearing? surely a judge wouldn't allow the father back in the house and issue a restraining order against you for being a victim. You are making less sense all the time. What did you threaten? Tell us the truth.

what did i threaten? i didnt threaten anything. that is the truth. i never hurt anyone nor threatened anyone which is why i am so confused. my ex lives with his mother and his mother has guardianship of my son which is why i think he is there. the restraining order against me is temporary until the next hearing nov. 9th, 2005. But now i am in violation and have a warrant out for being concerned about my son. ITS REDICULOUS how these 209A orders work.

my ex tried to file one against me and it was denied. the court found it rediculous that he was even attempting.
when his mother filed for one she stated she was scared of me and b/c i lived with her on a previous occasion it was granted. i dont know exactly what was said, i wasnt present when the order against myself was granted.

Then you have to respond at the hearing and fight the restraining order. YOu have to focus. Have you contacted legal aid or any of hte organizations I suggested?

yes i will be helped by a victim witness advocate, but will that help me in the warrant against me? can they really do that when i didnt know????

i have a warrant out for me right now. i am going to turn myself in monday morning so i dont get arrested. i will be arrained the same day. will it look better if i turn myself in??

More than likely they can they will be able to see what is going on, when do you talk or see them?

before i was told i had a warrant out for my arrest. 2 days ago. i found out i had a warrant today. i was up in cambridge when the police had showed up at my mom's to arrest me and my grandmother called my mom's cell phone saying they were looking for me. because i wasnt there a warrant was issued.
