Can you collect workman compensation when there is a hostile work environment which produces physical ailments from the stress?

Let's put it this way.

The law does not exclude stress-related illnesses from workers compensation claims.

However, it is VERY difficult to get a stress-related claim approved by workers comp carriers.

Yes, I have posted alot of threads. Getting answers, and fighting for what I believe in doesn't make me a borderline problem. But, I can see in your paranoid state of conciousness that you probably feel that your opinion of how many threads I have posted and questions I have asked that you may come to that conclusion. It does make you borderline when you have become that obsessive about it and you clearly have. Listen, you have fought the battle and lost. I truly feel that you probably did get screwed big time, but you need to seek out some counseling and try to move on or it will eat you alive.

I have not lost anything. My attorney is still working on my case. I am trying to get all answers, some different views, and I have many questions. I am in counseling and dealing with this. And, I will not just let it go. There are too many others who will suffer from this harasser as I did. Faith

faith - I'm very sorry to hear about your troubles but, your medical case is dismal.

First, there is no way you could prove that your migraines were caused due to workplace harassment, especially if you never told your doctor that you were under such stress.

Second, ulcers are not caused by stress. Physical stress, such as trauma or a major surgery can increase a persons chance of developing an ulcer but emotional stress cannot.

It was unfair what they did to you, and you should make your experience known but, trying to sue the company and allow it to take over your life is not healthy and it won't allow you to find peace. It will just drag everything on longer then need be and unfortunately you probably won't gain anything out of it (except time lost).

Big companies have high powered lawyers that will shred through your case. I watched my grandmother fight a case against a big company – she was fired after being diagnosed with an eye disease that didn’t allow her to sit in front of a computer all day (which she didn’t do anyway). She fought for years and was told by her lawyers that she had a rock solid case – in the end the judge sided with the big company and she got nothing. It wasn’t health for her to dwell on it once it was all over she sincerely regretted spending so much time and energy on it

This has taken over your whole life and what was perhaps a valid complaint has developed a life of its own so that anyone looking at it is not going to be able to ferret out the truth or be able to help you focus so anyone can help you.

Ok, All valid points. After reading all you wrote, I have to agree I have gone a bit too far dwelling on this case. I am getting counseling for dealing with all this. And for all others who are going through this, good idea to do. I understand the title "borderline", and know I am not that, just very angry and frustrated with the system. I mainly am getting to know our state statutes and laws to learn my rights and the rights of the company. I can see how easy it would be for anyone who has been severly harassed and fired to become "borderline" in dealing with issues. CBG has been very helpful and so have others on this forum. CBG must excells as a HR person. He is a careful thinker before making decisions, very analytical, and thoughtful. Again, thanks for helping. Faith
