Sorry, not a total stranger...Ive known her parents since a teenager myself. Im not encouraging her to defy parents, but yes I can give her a better home if it comes down to it...believe me, you dont know her home life. They dont have any issues w/me & I fully believe her mom will come around, mainly because she wont want the hassle...enuf said. Trust me, the oldest daughter got the heck out of there as soon as she could too. Thats great if your teens havent had sex yet, but dont fool yourself also...things happen in the heat of the moment for 1 thing, & a parent having rules doesnt stop a kid from doin what they want sometimes. You arent w/em 24/7 so dont think it doesnt happen! And b/friend is 18??? OMG, according to some on here that makes him a sexual predator, ha ha!
I really don't understand why this is hard for you.

According to the law, your son is a sexual predator. the medical folks and the school administration are all mandatory reporters of the crime to the police.

All of them are.

soooo, how many other children did your son rape "in the heat of the moment" before this latest one? When did he start?

How does he feel about prison? good?

Malissak, while Idaho may see the consensual relations between a 19 year old and a 17 year old are legal, CA does not.

The girl CAN NOT come to CA without her parents' permission. That's the first issue. Until she is 18 or legally emancipated, she will not be able to runaway to CA without risk of being hauled home and placing those who aided her at risk for arrest in CA.

Second, if she DOES come out to CA, pregnant or not, if she and her boyfriend (your son) have sexual relations, it is a crime if she is under age 18. Anyone who AIDS in this arrangement can also be charged.

So, either she gets her parents permission or she waits until she turns 18 and then moves to California.

I have already posted the link to the law that says Idaho does NOT see consentual sex as lawful when the female is under 18. By state law definition, if the female is under 18 it is rape by definition.

So far Malissa has provided nothing to support her contention that it is legal in Idaho.

At no time was that ever said on my part...get real, no one's that stupid (at least that I know anyway) And why would you think I'd be "aiding" in any sexual activity?? Just because Im offering for her to live w/me isnt saying they share a room...never have, never will in my house til marriage. Lots of assumptions goin around! & to the one whose kids dont have sex & NONE of their friends do?? Ok, whatever you say....remember that ORAL sex is very popular right now & the kids dont even consider it sex...I know alot of parents just like you...not my kid, right?! And no, my son hasnt "raped" anyone...not that its any of your business, but this is his first love & he's still w/her. Im proud of my kid & the responsibility he's willing to take...theres lots of others out there just sleepin around, believe me. Wow...I see now why teens these days feel like they cant talk to anyone.

Some might say that had you actually been talking to your child, he wouldn't be in this predicament at all...

O and lets get over the whole prison thing, rape thing, whatever already....thats never been in the equation for ANYONE involved, including the Dr. shes already seen, the school, blah blah blah. We are all behind them @ this point in raising a healthy child.

If no one is running away, then unless the girl's parents are on board with her moving to CA it is not going to happen until her 18th birthday.

And, while you may claim your son has not committed rape, by the definition of Idaho law, that appears NOT to be the case. While he may no have FORCED anyone to have sex, here is the relevant LEGAL definition of rape in Idaho:

18-6101.Rape defined. Rape is defined as the penetration, however slight, of the oral, anal or vaginal opening with the perpetrator’s penis accomplished with a female under any one (1) of the following circumstances:

1. Where the female is under the age of eighteen(18) years.
Thus, it appears he could be charged with the crime of rape.

I searched for a provision that might be applies in a so-called "Romeo and Juliet" law, but could not find one. So, the evidence of his crime (which holds a MINIMUM one year in prison and a maximum of life) gestates in her belly. I have also read that there is no statute of limitations for this crime, so it can be charged any time down the road.

Now, realistically, is he likely to be prosecuted? Probably not. And even if prosecuted, the penalty is not likely to be dire, and they would likely reduce the offense to something less extreme. But, the point is that under the law he HAS apparently committed a very serious offense and he could be held accountable for that offense.

Now, if she wants to become emancipated, pursuant to section 32-202 she either has to marry your son (something that will require her parents to sign off on the marriage), or, a judge will have to sign off on it. The judge will have to first hear from a physician who will assert to the physical and mental capacity of the minor and agree that she i capable of entering into the physical and emotional requirements of marriage. The judge will also have to decide that the marriage is in the best interests of the minor to be wed, and of society. I strongly suspect that she will be 18 before this potentially expensive and timely proceeding is done.

So, the best bet here is for her to wait a few months for her to turn 18. Then, they can all move away or do whatever they want.

Cant support themselves?? My son is pulling in over a grand a week, after taxes, thank you very much. Pretty darn good for a 19 yr. old. And before you accuse him of doin something illegal, which Im sure someone will try to, he works in the construction field, moving up very quickly.
Thank you to CdwJava for bein halfway reasonable on here...you seem knowledgable & I appreciate your posts not being full of rude, obnoxious accusations. This all started as my wanting advice about laws for pregnant teens & turned into a near public lynching of a teen boy & its a bit ridiculous. Yes we may end up having to wait til shes 18 or her mother may change her mind, or we may have to go before a judge. You'd be surprised how many teens Ive seen over the yrs in the same situation...none have ever been prosecuted. It may be on the books somewhere but never enforced where I come from, especially when the girls parents dont want it. Im not advocating for teen pregnancy, but when it does happen, all you can do is support em & be proud of the way they try to make the best of it.

do you come from the same county in Idaho as the girl lives? If not, what you have seen is irrelevant. Although I am from a different state, I have seen such crimes prosecuted and it was with the parents of the girl actually not wanting it to be prosecuted. Do not speculate based on where you are from that the same thing is practiced in another area of the country. It may or may not be true.
