What is the name of your state (only U.S. law)? Pennsylvania

My daughter is 6 months old, her father is wanting 50/50 custody arrangment. is it possible for him to get this? I do not breast feed, she is on formula. He is not a bad father (just was not a great husband). I was hoping at the age she is that he would not receive 50/50 yet. How possible is this? Please anyone

Joint legal custody = likely (this means joint decision-making)

Joint physical custody = possible (all this means is that you both have some sort of physical custody but one of you will be the primary parent)

Actual 50/50 timeshare = not likely unless YOU agree.

He is wanting 50/50 with 2 weeks on 2 weeks off. We live 3 hours away from each other now. Is there anything he would specifically have to prove in order to receive 50/50? Is it unlikely because of my daughters age?

I am pretty sure that will not happen. 3 hrs apart, without both parents in agreement (even with...) is not going to happen.

That schedule is appalling for a 6 month old and it is NOT going to wash in court unless, again, you agree to it.

While bonding with both parents is absolutely essential to any child's wellbeing, it shouldn't be at the expense of either parent - and two weeks on, two weeks off for a 6 month old would absolutely create disharmony in my opinion.

I would stick to my guns if I were you. Start looking for "infant visitation guidelines" and show Dad some examples.

That would be an absolutely horendous schedule for an infant. There is virtually no likelihood that a judge would force that kind of a schedule on an infant. Dad honestly has no viable chance of 50/50.

What do you believe the chances are? 20%? 30%? or somewhere around 1%?

Unless you agree - less than 1%.

And if it was ordered, I'd appeal it. It honestly isn't in the best interest of the child and this is what is important; it's not about what the parents want.

I honestly can't see a judge anywhere ordering that against the wishes of one parent.

Although I do agree that it is possibly unlikely. it does not mean that it wont happen.. When my fiancee filed for custody of his son in Blair County, the mom was living in Lancaster County a little over 3 hours away, the Judge gave them 50/50 with 2 weeks on and 2 weeks off.. At the time he was 1 week shy of 6 months old.. (Oh I am sure someone on here is going to say I am lying or something, so if anyone wants to give me a fax number I would be happy to send a copy of the original custody order with names blackened out)*this was before he ended up getting full custody*

Then it is possible??????? I can not afford a lawyer for court. I have a fax machine if you could fax it to me, I do not mind the names being blackened out. Will send a private message to you with my fax number.

If you are being honest then I now know I have something to worry about :(

I don't believe you...not unless they agreed on it...and if they did, then they were BOTH horrendous parents.

Please disregard Jekyl. She has lead more than one poster astray with incredibly inaccurate information.

1. He wanted 50/50.. She did not.. Judge gave it.

2. As I stated, I would be more than happy to fax it to anyone who wants to see proof that it did happen. As I just faxed it to her as well.

3. Times are changing, fathers have just as much right to their children as the mothers, and that is what the Judge told him. Had it been up to mom, then dad wouldnt have had anything.
