Have you tried calling legal services in Fresno yellow pages to see if they can file for you?

Sorry Miss Met. I wasn't sure about putting different issues in the same thread, but will keep them together. I actually called 3 separate places yesterday and today and have phone tagged with 2 of them and the one I did get through to I only spoke to secretary who took my info down and I have yet to hear from anyone there. I have a few more places I can call...there was a 24 hour legal assistance place I was referred to in Fresno, but both numbers turned out to be disconnected. And, in reference to speaking to her, she is refusing to speak and has insisted that my only contact with her be by email, yet I have still offered for us to speak when necessary like discussing the children's medical issues. But, to no avail... :( If I cannot get any help this week with filing from a Fresno agency I plan on pleading with my boss on Friday to allow me to have Monday off. I'm not holding my breath though. I'll keep you posted.

Go to the yellow pages, look under Paralegal services, there are 27 listed for Fresno, some of which have email addresses in addition to phone numbers, you should be able to find someone who can do your filings for you although you may have to mail them a copy with the original signature.

Look on the Fresno Superior court site, http://www.fresnosuperiorcourt.org/ there is a filing drop box on the 4th floor, Special Notice: Reduced Clerk's Office Hours: 8 AM – 3 PM


What:
The Clerk’s Office hours are 8 AM to 3 PM. Courtroom hours will not change; each will remain in session until adjourned for the day. Courthouses remain open to the public until 5 PM. The Law Library and Probation Department hours have NOT been reduced.

Why:
State budget cuts means staff reductions and no overtime. Reduced hours needed to allow uninterrupted time for staff to process documents. Fewer customers will be served each day.



4th Floor Drop Box: Room 401


Documents may be filed for Appeals, Civil, Criminal, Family Law, Probate and Traffic cases. If personal contact with a clerk is necessary, public must return another day before 2 PM.

* There is a time clock at this Box. Papers may be filed at the drop box until 5 PM.
* Documents filed before 5 PM will be processed as of the day filed.
* All documents filed after 5:01 PM will be processed as of the next business day.
* No cash payments accepted. Check or money order only.


You might drive up tonight and drop there off, I don't know the hours the drop box is available bit it is available after 5 pm.





Have you contacted the Bar association re the return of your entire file?

Just a thought. My husbands attorney told him that with joint legal custody , his ex-wife can not create bills and expect him to pay. You are not responsible for this bill if you did not agree to them going to the dentist. I have a copy of the joint custody guideline he got from his attorney if you want or need it. I bet she will compromise after she sees that she is solely responsible for this bill.

Yes, I called the state bar association who said that I must put my complaint in writing attached to their complaint form. I explained that I did get some of my file back (the documents that I sent the attorney), but not all of it. She stated they could not help me until I got that form filled out, which I will do tonight after work.

Good, don't forget about the fee dispute also. Have you considered the after hours drop box or ocntacted one of the 27 paralegals listed in the yellow pages?

My girlfriend and I just did this and of the 27, 21 are actually in the Fresno area. We just went down the list. She got someone on the phone at an agency there who said they did not prepare paperwork, but after explaining our sad tale, the woman directed her to fax the completed paperwork to her and she would look it over then fax any feedback to us to fix then overnight to her for her to file.
She actually told my girlfriend that she NEVER does this, but would do this free of cost. BUT, she did tell my girlfriend that we could file it ourselves and it would be the same process, but she told her we would feel better if she filed it for us. She said that was cool too, so the ball is rolling there.

BTW, the therapist who saw my son without my permission is back in the country as of yesterday. Should I wait to hear from her, or would my calling her again constitute harrassment? :confused:

We actually spoke to the locar bar association in Frenso about the fee dispute, and was told to first go through the complaint process with the state then if still not satisfied come to them...
I'm glad you found someone to help you and to file for you, what a gift! Perhaps they will have a suggesiton of an attorney if and or when you can afford to retain one.

If the therapist was on vacation, they will need several days to catch up with their clients, give them until Wed of next week and then contact them if they haven't reached you yet.

Fill out the complaint for the local bar anyway re the fee dispute along with your evidence that you signed an agreement and copy of receipts or check and the court forms for sub/atty, and also complete your state bar complaint too, explaining that you don't have all the evidence because the attorney who claims he never represented you refuses to return your file, etc.

I attempted to contact the therapist today, but no word yet and I don't want to pester her, so I may wait one more week, but worry that too much time will pass. ???

I have some time finally to copy everything regarding the attorney deal and complaint so will get that taken care of this week. All this paperwork is killing me! :(

I just sent everything out to the wonderful lady who is helping us file and just waiting now for the return paperwork and court date. I had a question about time frame...I notice on the paperwork a section stating something in the gist of shortening the service time frame. What does that mean? And, who would that benefit? I'm confused. Thanks!

Did you leave a message? If not, simply leave a message saying that you appreciate all her help thus far and understand she should have returned from her trip last week. While you understand that it takes some time to catch up with her clients following a vacation, you are still concerned re your child and look forward to hearing from her soon. This is not harassment, shows you are considerate of her time, however you are also concerned for your son.

Sometimes when you can get a sooner court date that is needed so that they can be served before the court date, also allows for difficult service, neither should be the case since you will be serving by mail, be sure to pay for delivery confirmation so she won't be able to claim she didn't get served or refuse service on crrr delivery even though all you have to do is file the proof of service.

She was told by the judge that she cannot have obstacles in my way and that she was to make sure I could reach our children whenever I called...obviously that is not happening. I feel frustrated and worry about them being so far gone from me. :( Thanks again for all your help.

Child's age? CO information? What is going on with this other child...why contact problems with both/all of them? :cool:

Yes, Email the therapist and let them know their telephone message device /voice mail is either not working or full. Let them know you are becomming very concerned with the difficulty reaching them since they promised to contact you after their return from vacation. Are they in private practice or work for an agency or group that you can contact? You might have better luck by contacting the insurance carrier, she might respond to their call. SHe may be using the holiday weekend as an excuse.

Insofar as the problem with telephone messages and communication. Did you send a card? Add it to your list of examples of contempt. At least school is starting soon.
