Okay--I was just a little astoninshed that someone with a leg such as yours would be told to use that kind of equipment. I understand the need for range-of-motion therapy, but a Stairmaster??? I have no medical background, so chalk that up to my ignorance.

Following that train of thought it occured to me that one might need that kind of equipment to treat obesity, which would also explain your leg's delay in healing, and...well, it was a long train of thought that had to do with your disability qualifications, and I won't further derail your thread.

Good luck, I hope you find a fair resolution.

ETA: I just realized the quoted part of my post indicates it's quoting Ohiogal instead of Bonnie. I have no idea how that happened, but I was quoting Bonnie, not OG. Weird.

I believe the stairmaster would have been for muscle strength improvement. It really does not do anything for range of motion since you do not move your ankle that far when climbing stairs although, it could be for a knee, maybe.

Depending on whether the surgery was immediately after injury or the doctor tried to set the bone and allow the bone to mend itself (which is kind of what I suspect) , if it was what I suspect, there could be considerable muscle tone loss due to casting for an extended period of time and strength training for the leg would definitely be proper.

If the surgery was immediate after the injury, there is generally no muscle loss as there is little reason the leg cannot be walked on immediately after surgery, or at most, a very short period and as such, no atrophy of the muscle.



Bonnie, were you casted for some period of time prior to surgery? Without that, a frozen ankle and muscle building doesn't make a lot of sense. Obviously this has nothing to do with the situation, more curious than anything.
 
Long story!

The first hospital that i went to, knocked me out twice and tried to set the bones! After the second time, they said to me" Well , we almost got them straight" and tried to send me home! They told me that I probably wouldn't need surgery. I would probably be OK. In my morphined state of mid I knew something was not right with that! So demanded to go to a real hospital, the doctor thru off his coat and start badmouthing people with MY kind of insurance. Ten minutes later I was being transported by ambulance to a hospital in the city!They immediately took me into surgery, stabilizing the bones. Five days later they did another surgery, plating and 24 screws! After two weeks they sent me home with no cast! They gave me a boot that I could not wear! What happened was my Ankle and foot had healed straight forward. I foot was pointing straight ahead. I had to go in for a day surgery, they didnt cut me open this time, but they manipulated my ankle into the right position and then they casted it! I could not put weight on it for a few more months, several casts later. I was finally able to wear the boot, by then my ankle was frozen in place! I had no muscle left, and still don't. its half the size of my other leg!

so, you need muscle training and work on range of motion.

I would suggest some of these:

they work wonders on both strength and range of motion exercises for ankles. If you are still dealing with a PT, they would be able to show you the proper use of them for ankle work.



there are exercises for range of motion and strength for ankle that require absolutely no equipment not found in every house in the country as well.

similar for knee motion and calf muscle strength.

If your PT has not given you papers showing such exercises, I think I would question your PTs training.

machines are nice but you can do just about anything you need to do without a machine. The problem is, you have to do it, every day, and it hurts.

If you are not self motivated, plan on never being able to walk right again.
 
PT advice!

Yes i use bands and a few other things and I do them everyday...I DO want to walk normal!! Definately. love to dance! And believe me I hope to do it again very soon!!!

Another update !

OK, now I'm really being harassed by the property manager! My water bill was 5 days late . She gave me another eviction notice! The Lease does state that I am responsible for the water and electric. But a notice to vacate because I was 5 days late? Ive been late ever month since Sept. when my income stopped I pay it when I get my utility allowance from the housing authorority on the 1st day of the month.
I received papers in the mail today, they want me to sign a month- month tenancy! The guy from HUD told me NOT to sign anything! I think I will go with what he says!???? It really doesn't make any sense to me! I was recertified in DEC. The Lease ammendment states-" The term of the Lease as been RENEWED or REVISED for a one year period BEGINNING DEC. ,2009. I think they are trying to trick me into something! Also, in all of the paperwork it does say, that I can stay until they get paperwork back from my MD regarding my disability, and until the investigation from HUD is over!
I think I really need an attorney?????
Any ideas Layman????? Or from anyone?

I think that being late with your water bill 5 months in a row is a justifiable reason for her to be annoyed. No, that does not constitute illegal harassment.

It is not harassment for them to demand you pay your bills when they are due. You may have messed up big time by not paying the water bill. While you may have received a stay due to the disability situation, that does not mean they have to accept you not paying as agreed.

Have they sent you a pay or quit notice? If not, expect one soon. This is different than the prior cause for eviction so I would not think they would be restrained from acting on this cause of action.



to the month to month: Even you said something about HUD getting you on a month to month. From the sound of things, you are the only party to all of this that believes you have an active lease.

If you do not agree to some form of lease or have on in force, they have the right to boot you so I suggest you speak with HUD, or an attorney would be a great idea, to figure out what happened to the lease you claim is in force. Somebody is apparently misunderstanding the current situation.
 
Paying on time!

I am responsible for my own bill, for sure!
HUD told me not to sign it!
I just believe if the bill is in MY NAME ONLY, then if I am 5 days late and have to pay a late fee!!! That really should be my business! Maybe not! Not sure!
Yes they gave a 30 day eviction notice! FOR CAUSE! With about 9 days to rectify the situation, which in the LEASE it clearly states....WHEN I GET SUCH A NOTICE THAT THEY GIVE YOU 14 DAYS TO RECTIFY! I guess they can break their own rules!!
You are so right! I do need an attorney!

But you weren't late just once. You were late five months in a row. That doesn't make it better for your claim - it makes it worse. Once might be excused. Five consecutive times is a problem.

best of luck to ya Bonnie but if a person insists on shooting themselves in the foot, the most diligent observer cannot prevent them from eventually being successful. I think you are dedicated to losing this rather than requiring them to win.

Bonnie, I would recommend that you follow your HUD rep's advice: do not sign anything and do not initiate any contact with the management. Send copies of the new notices to the HUD rep. If you have access to a scanner, scan and e-mail them. HUD might find that these actions are in retaliation for filing a fair housing complaint, which is in itself unlawful: US CODE: Title 42,3617. Interference, coercion, or intimidation.

If I understand correctly, you have not been able to pay the water bill until you receive a utility allowance check each month. Continue to pay the bill as early in the month as possible. This reflects favorably on you since you're using the allowance for the purpose for which it's intended: utility payments. If you haven't already done so, explain this situation to HUD when you provide a copy of the notice.

Just to clarify, when a subsidized tenant's income is too low to maintain utility service, the housing agency provides a small subsidy to enable the tenant to keep the power/water on.

Next time you talk to HUD/FHEO, ask if they recommend that you get a lawyer. HUD is representing you at this point. Involving an attorney who's not an expert in FH law might not be your best option.
 
Utilities!

Thank you Deana for the advice! I did talk to an attorney thru Legal Aid , and he really didnt know very much about this particular situation!
Also, back in September when my daughter moved out I let the housing authority know that, right away, told them that I had NO MORE INCOME! Since she moved out I didnt qualify for public assistance! The property manager did not adjust my rent according to my income, so I still had to pay what I was before I had no income!I did not get the utilitity allowance. It put me behind! I have caught up now! But I dont get the check until the 1st day of the month...so therfore I was 5 days late! I hate being late on anything, Im NOT a flake!
So, thanks I dont really know what to do, But I guess if HUD is representing me..that should b good enough!
 
Harassment!!!!

Just thought that I would let everyone know to especially all that said...the property manger had the right to give me a 30 day eviction notice!!!! For my water bill being late 5 days to the water company! Sure she had the right, but HUD called me today, and I told them that I got another eviction notice! He was very angry that they did that to me! They made an agreement with HUD to let me stay...until all of this has been investigated. Two hours a notice was put on my door! I was told by HUD to write a letter to the director asking if she had rescinded on their agreement !! That I could file an Harassment claim against them also!
Just an update to those who have been following this...gets more insane as the days go by!

the HUD resolution had nothing to do with you not paying your bills. That is a separate issue and the LL is allowed to evict you for a reason not even associated with the stay.

They made an agreement with HUD to let me stay...until all of this has been investigated.
but this has nothing to do with the HUD situation.

HUD guy can get mad all they want but they cannot force the LL to pay for you to live there and you not paying means they have to.

you are displaying a sense of entitlement you have no right to. The stay is not a panacea for every justification for eviction.
