Are you aware that he will have to return to his home country for 2 years (unless he can get a waiver) before he can file to adjust status based upon marriage?
he is " not subject to the two-year residence requirement"(two year home contry physical presence requirement) section 212(e)

I know he automatically considered part of household, regardless of where he sleeps, household and must be included in any computation of incomes...but he has no income....after he gets a job he will contribute.....and he is not refusing to cooperate with the program...that lady refused me....I have 2 kids, they are living with me.
You are OBVIOUSLY not reading the information we are providing to you.

(No wonder the social worker got a little testy.)

Why aren't you working? Where is your children's father and is he doing his part to support his offspring?

yes, he has the same address as me...I'm not planing to buy a house, but after he gets his employment authorization , we can move out and rent something.....he can not work right how, because he's from another contry ..and you know,....nobody will hire him....I'm not planing to stay on Welfare forever and this is an opportunity for me and for him , for a better life. He doesn't want to apply for welfare or something else and me neither.
and what do you mean by "hey will go after him to get their money back."....?I don't have a big head and I admit that I don't understand many things, but now I really do not understand ....if he has no income and can't work because he doens't have his employment authorization, why I'm accused of fraud?

And that would be why?

Honestly? With all of this dental work, you need to speak to an attorney not a message board.

Why can't your husband take care of the kids while you work?

You should be more self sufficient. But your ex should be paying to support his children...though if you're on welfare, he most likely IS paying, he's just paying the state instead of you.

You ARE married (according to you.) It's not an "IF," any more.
